The court system is difficult to navigate alone, but with the help of our expert criminal law solicitors, the road will become very clear. Our solicitors have a thorough understanding of the processes and procedures of each level of court and can guide you through them.

Police matters

Police cannot just arrest you because they feel like it. They must hold a reasonable belief that you have committed an offence.

Did you know that police do not have to handcuff you if you are under arrest? They must first consider the surrounding circumstances and whether you are a danger to them or the public at large. Furthermore, they will need to consider whether you will commit a further offence or try to escape in the absence of handcuffs.

Police interviews

If you have been called in for a police interview, you should contact George Sten & Co to find out more about your rights. Police cannot force you to be interviewed; it is voluntary, so prior to agreeing to an interview, contact us.

Court matters

Our specialised team of criminal lawyers are well versed in court manners and knows the court process inside out. The court process for criminal law matters is as follows:

Engaging your criminal lawyer

Engaging a specialised criminal lawyer is the first and most crucial step in the process. Your criminal lawyer will piece together the best possible criminal defence and will be able to advise you on the prospects of success for gaining bail and entering into a plea.

Committal hearing

At this stage, the Magistrate at the Local Court will consider whether you will be granted bail and whether there is enough evidence to proceed to trial. The prosecution will present the evidence against you and your lawyer will have opportunity to answer this evidence and provide a preliminary view of your evidence.

Trial

During the trial, all evidence will be presented. A jury may be present and if so, will be making the final decision at trial. If the jury finds you guilty, the Magistrate or Judge will sentence you. At this stage, the magistrate or judge will consider your character and the seriousness of your crime to determine suitable penalty.

During this court process, your criminal lawyer will be there to defend you and give you the greatest chances of walking out with a minimal penalty. Would you choose a family doctor or specialised surgeon to perform heart surgery on you? So why would you choose a general lawyer to defend you in a criminal matter? Our criminal lawyers at George Sten & Co are experts in the area of criminal law. We provide the highest level of legal defence and are fearless advocates for our clients. We will fight your case to the very end and are just as invested in your future as you are yourself.

We are dedicated to ensuring our clients are taken care of, so we are available 24 hours a day, 7 days a week on 0412 423 569. During business hours, contact us on (02) 9261 8640 or email us.
